1. Eligibility

To use the Service, you must:

• Be at least 18 years old with legal capacity for contracts
• Agree to these Terms
• Provide accurate, complete, current contact information
• Supply truthful contact and business information in your Shopify store
• Not be subject to EU, US, or UN sanctions, embargoes, or bans
• Pay Shopify invoices promptly (failure results in suspension)

By using the Service, you represent and warrant meeting all requirements and agree not to violate any applicable laws. Checkito may refuse service, close accounts, and change requirements at any time.

2. Subscriptions

Some parts of the Service are billed on a subscription basis ("Plan(s)") with recurring Billing Cycles (monthly). Subscriptions auto-renew under identical conditions unless cancelled. You may cancel through your account settings or by contacting support with 30 days' notice.

A valid payment method is required: credit card, ShopPay, GooglePay, or ApplePay. You must provide accurate billing information (full name, address, state, zip code, country, telephone number). Submitting payment information authorizes Checkito to charge subscription fees automatically.

3. Free Plan

Checkito may offer free subscriptions for development stores at its discretion. No charges apply to Free plans. Checkito reserves the right to modify Free plan terms or cancel the offer at any time without notice.

4. Free Trial

Checkito may offer limited-time Free Trials. Billing information may be required for signup. If provided, no charges apply until trial expiration. On the final day, unless cancelled, you will be automatically charged applicable fees for your selected subscription type.

Checkito reserves the right to modify Free Trial terms or cancel the offer at any time without notice.

5. Fee Changes

Checkito may modify subscription fees at any time, effective at the end of the current Billing Cycle. Reasonable prior notice will be provided to allow subscription termination before changes take effect. Continued service use after fee modification constitutes agreement to the new amount.

6. Refunds

Except when required by law, paid Subscription fees are non-refundable. Checkito may consider refund requests on a case-by-case basis at its sole discretion.

7. Authorized Use of the Service

Use the Service only for lawful purposes consistent with Checkito's nature and purpose. Unauthorized use may constitute criminal offense and/or result in damages claims.

8. Accounts

You must provide accurate, complete, current information when signing up. Failure to do so constitutes a breach and may result in account termination.

You are responsible for safeguarding your access password and all activities under your account, whether with Checkito or third parties. Do not disclose your password to anyone. Notify Checkito immediately of any security breaches or unauthorized account use.

9. Intellectual Property

The Service and its original content, features, and functionality are and shall remain the exclusive property of Checkito and its licensors. The Service is copyright-protected. Trademarks and trade dress cannot be used without prior written consent.

10. Links To Other Websites

The Service may contain links to third-party websites or services not owned or controlled by Checkito. Checkito has no control over and assumes no responsibility for third-party content, privacy policies, or practices.

You further acknowledge and agree that Checkito shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such third-party websites or services.

11. Data Protection

You acknowledge that your information and posted content are collected, held, and used per Checkito's Privacy Policy.

12. Termination

Checkito may terminate or suspend your account without prior notice or liability for any reason, including breach of these Terms. Upon termination, your service rights cease immediately.

To terminate your account, simply discontinue Service use and cancel your subscription.

13. Limitation Of Liability

In no event shall Checkito, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

This applies regardless of whether based on warranty, contract, tort (including negligence), or other legal theory, and regardless of whether Checkito was advised of the possibility of such damage.

14. Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

15. Governing Law

These Terms shall be governed by and defined following the laws of Czech Republic. Checkito and yourself irrevocably consent that the courts of Czech Republic shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.

16. Changes

Checkito reserves the right to modify or replace these Terms at any time. Material change determination is at Checkito's sole discretion.

Continuing to use the Service after revisions take effect means agreement to the revised terms. If you disagree, you must stop using the Service.

17. Partial Invalidity

If any provision of these Terms becomes illegal, invalid, or unenforceable under any jurisdiction's law, the remaining provisions' legality, validity, or enforceability shall not be affected or impaired.
